Twelve Actions to Stop Obamacare

We the People can stop Obamacare in 2014. It will not collapse on its own. Until it is pulled out by the roots, Obamacare is a danger to Americans, freedom, and the American dream. Stopping the Obamacare exchanges is key to stopping Obamacare.

 

You can help. Below is a unique health freedom version of  "the 12 gifts of Christmas 2013" - twelve reasons for hope that need to be heralded, enhanced and upheld in every state.  In that vein, I offer you 12 specific action opportunities to make sure that happens. Don't miss the italics:

 

  1. Oklahoma's Halbig vs. Sebelius Lawsuit Advances - If successful, Halbig will virtually shut down Obamacare. Where there are no subsidies ("affordable coverage"), there are no mandates or penalties. Halbig argues the law allows subsidies only through state exchanges, not the federal exchange. There are three other lawsuits challenging the subsidies. Expect one or all to reach the U.S. Supreme Court. I asked OK Attorney General Scott Pruitt what he'd like people to do and he said: Talk about this lawsuit broadly, including in letters to editor, tweets and blog posts.

 

  1. "No More Funding" Deadline Looms - On January 1, 2015, federal funding for state-established Obamacare exchanges goes away. Section 1311 of Obamacare says, "In establishing an Exchange under this section, the State shall ensure that such Exchange is self-sustaining beginning on January 1, 2015..." Refusing to enroll is important. Make the Exchanges non-sustaining by discouraging enrollment.

 

  1. The Obamacare "Kill Bill" - The American Legislative Exchange Council (ALEC) has drafted "model legislation" for states. If enacted, the state would revoke the license of any insurer that accepts federal subsidies through an Obamacare exchange. This would stop the IRS from penalizing businesses that do not offer health insurance (See #1 above). Tell your state legislator to introduce the bill.

 

  1. Enrollment on Life Support - HHS expected 500,000 people to be enrolled in Obamacare by October 31, with 7 million by March 31, 2014. But only 137,000 enrolled by November 30 through the federal exchange. Another 227,000 enrolled through the 14 state exchanges. PBS NewsHour has an amazing "expectations vs. reality" chart. Tell people why they should refuse to enroll.

 

  1. Uninsured Say NO to Obamacare - The uninsured appear disinterested and the young and healthy - Obama's target for wage and wealth redistribution - are not signing up for Obamacare. The administration needs 2.7 million Y&H enrollees. Unless otherwise linked, the following stats are taken from a RWJF report and an expert blog. Note: "signed up" doesn't mean enrolled. Let the young and healthy know that Obamacare is a ripoff and Obamacare coverage limits access to care.

  1. Constitutional Protections Remain - Forcing states to expand Medicaid was ruled unconstitutional. States can't be commandeered by Congress. Thus far, 25 states refuse to expand Medicaid and 34 states refuse to build a state Obamacare exchange. Ask your Governor and state legislators to stay the course.

 

  1. Exemptions and Alternatives are Available - You can't be forced to buy insurance and legal alternatives to Obama's exchange include nine exemptions. Exemption #9 includes 12 "hardship exemptions." Tell your friends and family there are choices and no one has to enroll in Obamacare.

 

  1. PolitiFact's Lie of the Year - PolitiFact, a project of the Tampa Bay Times, has named President Obama's statement, "If you like your health plan, you can keep it," the LIE OF THE YEAR. Remind everyone that the President has proven he and Obamacare cannot be trusted.

 

  1. Resistance is on the Rise - The young are refusing to sign up; people may choose the penalty over the policy; more media are refusing to protect Obama; concerned Americans are opting out of the exchange, and doctors are refusing to participate in Obamacare. Ask your friends, family, colleages and doctors to refuse to enroll in the Obamacare exchange.

 

  1. Obamacare Realities Go Public -The pain realities of Obamacare mean 2010 Democrat smiles have been replaced with 2013 frowns, apologies, delays, special exemptions, "tech surges" and administrative obstacles to Congressional inquiries. Make sure everyone knows their pain is due to Obamacare - and that there are legal alternatives.

 

  1. Democrats Head to the Hills- As people lose jobs, wages, doctors and insurance, Democrats are panicking. Soon employer policies will be dropped or Obamacare-priced. Fully 50 - 100 million more cancellations are expected. Democrats facing 2014 elections are trying to figure out what to do. Call or write your member of Congress and tell them to REPEAL IT.

 

  1. News to Know:

Going ... Going ... Gone

While the Obamacare website was scrambling to fix glitches, Minnesota's Watchdog.org discovered MNsure exchange director April Todd-Malmlov took a 8-day vacation to Costa Rica with her partner, state Medicaid Director Jim Golden. MN Gov. Mark Dayton defended her right to a pre-scheduled trip, but on December 17, during an emergency closed-door teleconference with the MNsure Board, Ms. Todd-Malmlov "resigned" without a severance package. Her replacement, Scott Leitz, has been the subject of a recent internal investigation. Malmlov joins Oregon, D.C. Hawaii, and Maryland exchange directors in leaving.



Obama Popularity Sinks with Youth

A majority of Americans under age 25 --  the youngest millennials - would favor throwing President Obama out of office, reports the National Journal. A study by the Harvard University's Institute of Politics found 52 percent of young people want to recall "all members of Congress" and 47 percent want to recall Obama. But 52% of the youngest millennials -- ages 18 to 24 -- would recall him.



Lawmaker Suggests Abandoning State Exchange

Maryland Health Connection, the website intended to help uninsured Marylanders find health insurance, has so far done nothing more than keep thousands from applying. U.S. Rep. John Delaney (D-MD) is so unimpressed that he has suggested Maryland abandon its state health exchange website in favor of using the federal government's exchange. Things must be truly bad when using the disastrous federal exchange is a suggested improvement.



Medicaid Applications are Retroactive

Ohio residents who applied for Medicaid through the federal exchange website are being advised to sign up through Ohio's Medicaid site. Due to a glitch, Medicaid applications through the federal exchange will be delayed in reaching the state of Ohio. Despite the delay, new Medicaid enrollees can still receive coverage. Medicaid eligibility works retroactively for three months from the application, so one could apply in March 2014 and be covered from Jan. 1, 2014.



Americans Critical of Obamacare

According to an Associated Press-GfK poll, Americans do not view President Obama's health care overhaul favorably, with many thinking it is responsible for eroding coverage. Americans who already have health insurance are blaming the ACA for their rising premiums and deductibles. And 75% of those Americans also think the rollout of coverage for the uninsured has gone poorly.



Hospital "Kidnaps" Teen

Diagnosed with mitochondrial disease, Justina Pelletier has undergone various surgeries. However, when she was admitted to Boston Children's Hospital in February with the flu, new doctors diagnosed her with somatoform disorder, a mental illness. The hospital then took custody of 15-year old Justina, claiming her parents were too active in pursuing treatments for the original diagnosis. Justina is living at the hospital, and only allowed to see her parents once a week.



Health Law Hurts Obama

The law that was supposed to be his legacy looks to be Barack Obama's downfall. With the disastrous rollout of the federal health care law, Obama saw an all-time low in his performance rating, with 54% of Americans disapproving of the president's job performance. In the poll conducted by The Wall Street Journal and NBC News, Americans indicated that they have lost confidence in Obama's honesty, leadership and ability to handle a crisis.



Unwanted Genetic Disclosures Possible in Future

Genetic testing is increasingly popular, with thousands of Americans gaining interest in testing themselves for genetic history and potential mutations. Bioethicist Robert Kiltzman of Columbia University stresses that testing positive for something doesn't always mean one will get sick. Likewise, testing negative doesn't guarantee immunity. Klitzman is concerned that people will be given genetic information about themselves "whether we want it or not." ( The Wall Street Journal, Dec. 9, 2013).



Obamacare's Bad Numbers

Despite the Obama administration's best efforts, they can't cloud the true facts of the Obamacare failure. Obamacare enrollment is running negative, meaning that of the approx. 5 million who had their plans cancelled by the ACA (not counting the uninsured Americans who did NOT have plans cancelled), 4 million are not using Obamacare. Likewise, enrollment is much lower than projected, and the White House has resorted to fudging the stats to keep up appearances.



What Obama "Really" Meant

Former White House official Ezekiel Emanuel is defending Obamacare and the president's promises that Americans could keep their doctors and plans. According to Emanuel, the president really meant that Americans had the freedom to choose to pay more to keep their preferred doctors on more expensive plans through Obamacare. That's putting spin on a rather simple statement: "if you like your plan you can keep your plan."



HIV Groups Claim ACA Discrimination

Obamacare prohibits health insurance plans from discriminating against people that are sick -- or charging people with pre-existing conditions more than their healthy peers. Despite this, 31 HIV/AIDS organizations charge discrimination because many plans offered through Obamacare do not cover all HIV drugs and include "egregious cost sharing designs." That's not discrimination; that's health care rationing and wealth redistribution. Perhaps like Congress, they never read the bill.



HHS Wants "Right Mix" in Obamacare

While attempting to fix the errors plaguing the government exchanges, the Obama administration is re-focusing its attention on enrollment, particularly trying to entice younger, healthier people to enroll in an effort to offset the medical costs of older enrollees. "It is about not only just the numbers of individuals, but... hopefully getting the right mix of individuals," said health and Human Services Secretary Kathleen Sebelius. "Right mix" is a euphemism for "federal ripoff."



England Rations Surgery

England has 53 million people but does only 4.6 million surgeries per year. Disregarding the fact that multiple surgeries may be done on one person, England has a surgical rate of 8.6%. In contrast, Minnesota has 5.3 million people, one-tenth the size of England, but does 2.5 million surgeries per year. Again disregarding the fact that certain individuals receive multiple surgeries, Minnesota has a surgical rate of 47%.

Stats of the Week:

39.1 million visitors visited the State exchanges and federal exchange (Healthcare.gov), yet only 364,682 Americans selected Obamacare coverage plans -- but if no premium was paid they are not yet enrolled in the new "Medicaid for the middle class."
